KSL Partner Mark Semeraro recently settled a personal injury case for a New Jersey client that resulted in an insurance policy limits settlement to a woman struck by a car. The settlement was reached with New Jersey Manufacturers Insurance Company.
In this case Mrs. Sunit Duggal, a hotel employee, was walking home from work on November 7, 2013 along North 5th Street in Saddle Brook, N.J. While crossing Lanza Avenue she was struck by a motor vehicle turning right onto Lanza Avenue. As a result of the driver’s negligence, Mrs. Duggal sustained significant injuries to her left leg including a fractured tibial plateau and had to undergo immediate surgery.
The tibial plateau is one of the most critical load bearing areas in the human body; fractures of the plateau affect knee alignment, stability, and motion. Appropriate treatment of these fractures is critical for minimizing patient disability and reducing the risk of complications, particularly post traumatic arthritis.
After surgery, Mrs. Duggal was hospitalized for approximately one month. Upon release from the hospital, she continued to suffer negative effects of the accident and permanent injuries to her left peroneal nerve in her lower leg.
Refusing to settle the case, NJM Insurance opted for a trial. As the trial date approached, however, Mr. Semeraro, with the help of expert orthopedic and neurological experts, successfully negotiated a settlement that approached the $300,000 policy limits of the driver. Mrs. Duggal is recovering and hopes to return to a full and active life.
